The terms governing your use of Kavanagh Industries products and services. Subject to the RigidTrust™ Nine Bills of Rights.
Effective Date: March 11, 2026 — Last Updated: March 11, 2026
These Terms of Service (“Terms”) are a legal agreement between you and Kavanagh Industries LLC, a Michigan limited liability company (“Company,” “we,” “us,” or “our”). By accessing our website at kavanaghind.com, subscribing to any service, or purchasing any product, you agree to be bound by these Terms. These Terms incorporate and are subject to the RigidTrust™ Nine Bills of Rights — where any provision of these Terms conflicts with a right established in RigidTrust, the provision more favorable to the stakeholder prevails.
The Nine Bills of Rights published in the RigidTrust™ Constitutional Framework represent the non-negotiable minimum standard of how Kavanagh Industries treats every person in our ecosystem. No modification to these Terms — whether by amendment, update, or new version — may reduce, narrow, or eliminate any right established in those Nine Bills. Rights may only expand. They will never contract. If any clause in these Terms is found to conflict with a Bill of Rights provision, the Bill of Rights provision controls. This constraint is itself non-modifiable.
Kavanagh Industries LLC is registered in the State of Michigan. Our principal place of business is in Michigan, USA. USPTO Provisional Patent #63/991,057 filed February 25, 2026. All inquiries may be directed to shaun@kavanaghind.com.
“Assets” means any files, 3D scans, CAD models, Digital Twins, telemetry data, toolpath files, photographs, provenance metadata, or other digital content you upload, create, or store on KI platforms.
“Heritage Assets” means any Asset you designate as heritage content — including scans of irreplaceable physical objects, family heirlooms, cultural artifacts, and items with unique provenance — stored under the Heritage preservation classification within RigidVault. Bill VII
“Digital Birth Certificate” means the forensic timestamp and origin record generated at the moment an Asset is uploaded to RigidVault, establishing a legally defensible proof of ownership. Bill I
“Sovereign Storage” means storage on physical hardware owned and operated by Kavanagh Industries within the United States, without reliance on third-party cloud providers.
“Zero-Knowledge Streaming” means the process by which manufacturing instructions are delivered to a machine without the machine operator possessing or having access to the underlying raw design file. Bill II
“Custodian” means the primary account holder responsible for Heritage Assets, including the power to designate successors. Bill VII
Kavanagh Industries offers a range of products and services through its ecosystem of brands, including but not limited to:
RigidVault is offered as a recurring subscription. Current tiers — Explorer ($5/mo), Creator Basic ($49/mo), Creator Pro ($99/mo), Creator Max ($199/mo), Industrial ($1,000+/mo), and Sovereign (custom pricing) — are described on the RigidVault product page. Features, storage limits, and capabilities vary by tier.
You must be at least 13 years of age to create an account. Users between 13 and 17 require verifiable parental or legal guardian consent. You must provide accurate information and keep it current. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
All data stored in RigidVault resides on Company-owned hardware located in the United States. We do not use third-party public cloud services (AWS, Google Cloud, Azure, or similar) for storage of customer data. Bill I Bill II
We will provide at least 90 days’ written notice before any price increase takes effect for your subscription tier. During those 90 days, you may cancel without penalty and export all your data at no charge. Bill V
You may cancel your subscription at any time. Upon cancellation:
Heritage Asset Exception — Bill VII: Heritage-flagged Assets are never automatically deleted upon subscription cancellation, account inactivity, or tier downgrade. If a Heritage Custodian’s subscription lapses, their Heritage Assets are moved to cold storage at no charge and remain available for export indefinitely. Active access (editing, sharing, streaming) requires a current subscription, but the data itself is never at risk of deletion.
To permanently delete a Heritage Asset, the Custodian (or verified successor) must submit a written deletion request. Kavanagh Industries will confirm the request, execute the deletion, and provide a certified deletion record.
If you cancel within the first 14 days of your initial subscription or any renewal, you are entitled to a full refund of that billing period. After 14 days, no refunds are issued for partial billing periods. Refunds are processed through the original payment method within 5–10 business days.
Heritage Assets are stored at the highest available redundancy level on our sovereign hardware. They are never automatically purged, never moved to lower-reliability storage tiers, and never deleted without the explicit written consent of the Custodian. Bill VII
Every access to a Heritage Asset — every view, download, export, share, or modification — is recorded in an immutable, forensic chain of custody log. This log is available to the Custodian at any time and serves as a permanent audit trail. Chain of custody records are never altered or deleted. Bill VII
The Custodian may designate one or more successors who will inherit custodianship of Heritage Assets. Successors are designated in writing through the RigidVault account settings. Upon notification of the Custodian’s incapacitation or death — verified through reasonable documentation such as a death certificate, power of attorney, or court order — custodianship transfers to the designated successor(s) per the Custodian’s recorded instructions. If no successor is designated, Heritage Assets are preserved in cold storage indefinitely until a valid legal claim is made. Kavanagh Industries will never unilaterally destroy Heritage Assets for lack of an active Custodian. Bill VII
Heritage Assets represent irreplaceable objects — a grandfather’s tool, a carved door, a one-of-a-kind pattern. Kavanagh Industries and all personnel who interact with Heritage Assets will treat them with the reverence and care appropriate to their nature. Bill VII
Every Asset you upload, create, or store on our platform belongs to you. Kavanagh Industries claims no ownership interest in your intellectual property. We hold your data in trust on your behalf. By uploading content, you grant us a limited license solely to store, back up, and deliver that content to you as part of the service. This license terminates when your data is deleted. Bill I Bill II
At the moment of upload, every Asset receives a Digital Birth Certificate — a forensic timestamp establishing proof of origin. This record is immutable and cannot be altered by Kavanagh Industries or any third party. Bill I
Your data will never be used to train any artificial intelligence model — whether operated by Kavanagh Industries or any third party — without your explicit written opt-in consent and a direct royalty agreement. This is not a default you have to opt out of. Absence of consent means the data is never touched. This applies to all subscription tiers. Bill I Bill IX
If you opt in to AI training data contribution, RigidFlow marketplace distribution, or any other revenue-sharing arrangement, Kavanagh Industries will provide transparent, auditable royalty accounting. Royalties are calculated quarterly and paid within 30 days of quarter end. Royalty structures are governed by the separate RigidRoyalty Agreement. See kavanaghind.com/rigidroyalty. Bill I
You may export all of your Assets at any time in open, standard formats (including but not limited to .STEP, .STL, .OBJ, .PLY, .PDF, .CSV, and .JSON). There are no export fees, no throttling, no artificial delays, and no proprietary format lock-in. Bill I Bill V
All RigidVault accounts support beneficiary designation. You may designate one or more individuals to receive access to your vault Assets upon your death or incapacitation. Non-Heritage Assets transferred to a beneficiary follow standard subscription terms for the receiving account. Bill I
When Assets are used in RigidFlow manufacturing jobs, the raw design file is never transmitted to the producing facility. RigidAI converts the design into encrypted RigidPulse motion code that streams directly to the machine. The manufacturer executes the job, the creator gets paid, and the underlying IP never leaves the vault. Bill I Bill II
No AI system operated by Kavanagh Industries will execute a kinetic action — move a machine, start a cut, activate a motor — without a human operator confirming a cycle-start command. AI recommends. Humans decide. Bill IX
When RigidAI makes a recommendation, issues an alert, or modifies a parameter, it must cite the data source, applicable standard, and reasoning. No black boxes. Every AI output is auditable. Bill IX
The success of our AI is measured by whether workers earn more, not by how many jobs are eliminated. Bill IV Bill IX
RigidAI trains only on data from ecosystem participants who have explicitly opted in. No data scraping. No passive collection. No inference from metadata. Opt-in is affirmative, specific, and revocable at any time. Bill IX
Kavanagh Industries commits to an independent, third-party ethical audit of all AI systems annually. The results will be published publicly — good or bad. The audit will never be suppressed, edited, or delayed for commercial convenience. Bill IX
A two-person shop receives the same platform opportunities as a 200-person facility. RigidFlow matches jobs based on verified capability, equipment, quality history, and proximity — never on advertising spend or payment for preferential placement. Bill V
The RigidFlow dispatch algorithm is published and audited annually. Changes are announced at least 30 days before taking effect. Bill V
Commission rates are fixed and published. Changes require 90 days’ written notice. Your operational data is never used to recruit your customers away from you. Bill V
RigidFlow prioritizes local job matching first — keeping work in the communities where it originates whenever a capable local facility is available. Bill VI
Remote participation in the Kavanagh Industries ecosystem is a first-class mode of operation — not an accommodation. Our platforms are designed so that people with disabilities, veterans transitioning to civilian careers, and individuals rebuilding their professional lives have equal access to opportunities, training, and earning potential. Bill VIII
RigidPulse safety data — including sensor readings, anomaly alerts, and safety interlock status — is never suppressed, delayed, or overridden for production throughput. If a safety system says stop, the machine stops. Safety overrides are never disabled in training environments. Bill III Bill IV
Payments are processed through Stripe, Inc., a PCI-DSS Level 1 certified payment processor. Kavanagh Industries does not directly store your credit card number. By providing payment information, you authorize us to charge the applicable subscription fees on a recurring basis until you cancel. All prices are in U.S. dollars. Applicable sales tax will be calculated and collected as required by law.
You agree not to use our services to:
Violation may result in account suspension or termination. We will provide written notice and a reasonable opportunity to cure before permanent termination, except in cases of immediate safety risk or clear illegal activity. The 30-day data export window applies even in termination for cause.
All trademarks, trade names, logos, and branding associated with Kavanagh Industries, RigidPulse, RigidCore, RigidVault, RigidSense, RigidFlow, RigidDrive, RigidAI, RigidTrust, RigidRoyalty, and all other Rigid-prefixed names are the property of Kavanagh Industries LLC. USPTO Provisional Patent #63/991,057 covers certain technologies used in our products.
Before initiating any legal proceeding, both parties agree to attempt good-faith resolution for 30 days. Most disputes can be resolved using forensic RigidSense data — timestamps, telemetry, chain of custody records.
These Terms are governed by the laws of the State of Michigan. Disputes shall be resolved in Macomb County Circuit Court or the Eastern District of Michigan federal court.
Kavanagh Industries maintains a safe channel for reporting violations. Good-faith reporters are protected from all retaliation — including account suspension, reduced marketplace matching, or adverse trust score impact.
To the maximum extent permitted by Michigan law:
We maintain RAID-10 redundancy and regular backups, but no storage system is infallible. We recommend you maintain your own backup copies of critical files.
We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance. RigidPulse supports local offline operation for connected machines. Bill II
We may update these Terms with at least 30 days’ written notice sent to your account email. Continued use after the effective date constitutes acceptance. If you disagree, you may cancel and export all data at no charge during the notice period.
No modification to these Terms may reduce, narrow, or eliminate any right established in the RigidTrust™ Nine Bills of Rights. This constraint is itself non-modifiable. The Bills of Rights represent the permanent constitutional floor of the Kavanagh Industries ecosystem.
We may terminate or suspend your account if you violate these Terms. You may terminate at any time by canceling. Upon termination, the 30-day export window applies for standard Assets and Heritage commitments (Section 5) remain in full effect. Sections 5, 6, 8, 14, 15, and 16 survive termination.
If any provision is found unenforceable, it is modified to the minimum extent necessary, and all other provisions remain in full effect.
These Terms, together with our Privacy Policy, the RigidTrust Constitutional Framework, and applicable service-specific agreements (including the RigidRoyalty Agreement and Heritage Custodianship Agreement), constitute the entire agreement between you and Kavanagh Industries LLC.
